1. About These Terms

These Terms of Service govern your use of the public website operated by Acuity Counseling, PLLC (“Acuity Counseling,” “we,” “our,” or “us”). Please read them together with our Privacy Policy. If you do not accept these Terms, please do not use the website.

These Terms apply only to the public website and related non-clinical online activities. They do not replace or modify any informed-consent document, financial agreement, Notice of Privacy Practices, service agreement, or other document governing clinical care.

2. Website Information and Clinical Care

This website provides general information about Acuity Counseling, therapy services, clinicians, educational topics, employment opportunities, and ways to contact us. Website content is educational and informational only. It is not medical or mental health advice, diagnosis, treatment, or a substitute for care from a qualified professional.

Viewing the website, sending a general inquiry, requesting an appointment, or submitting information does not by itself create a therapist-client relationship. A clinical relationship begins only after Acuity Counseling accepts you as a client and the required intake and consent process is completed. The website does not guarantee clinician availability, appointment acceptance, insurance coverage, treatment outcomes, or that a particular service will be appropriate for you.

3. Emergencies and Crisis Support

Acuity Counseling is not an emergency or crisis-response service. Do not use website forms, email, or appointment-request tools for an emergency or time-sensitive crisis.

If someone is in immediate danger, call 911 or go to the nearest emergency department. In the United States, call or text 988 for the Suicide & Crisis Lifeline. Additional options are available on our Crisis Resources page.

4. Website Forms and Communications

General contact and employment forms are not secure clinical communication channels. Do not use them to submit diagnoses, treatment information, medical records, Social Security numbers, financial account information, or other highly sensitive information unless a form specifically requests the information and provides a secure method.

When you provide contact information through a general form, you authorize us to use it to respond to that request. This does not enroll you in marketing messages. If you separately subscribe to a newsletter, we may send newsletters, practice updates, or educational and promotional emails. You may unsubscribe at any time through the link provided in an email.

We do not currently use this website to enroll visitors in SMS marketing. Service-related communications for established or prospective clients may be handled through SimplePractice or another communication method selected during the intake process.

5. Secure Tools and Third-Party Services

Appointment requests, scheduling, client-portal access, telehealth, billing, secure forms, and clinical communications may be provided through SimplePractice. Information entered into a SimplePractice tool is transmitted directly to that platform and is governed by the terms, privacy practices, and clinical agreements that apply to that service. The public website itself does not store clinical records.

The website may also link to other third-party websites or services. External links are provided for convenience and do not mean that we control or endorse every statement, product, or practice on those websites. Your use of a third-party service is governed by that service’s own terms and policies.

6. Employment Applications

Employment information and application materials must be truthful and complete to the best of your knowledge. Submitting an application does not guarantee an interview, offer, or employment and does not create an employment relationship or contract. Acuity Counseling may verify application information and conduct permitted background or credentialing checks before making an offer.

Employment application information is handled as described in our Privacy Policy. Do not include clinical information about clients or other protected or confidential information in an application.

7. Acceptable Use

You may not use the website to:

• Violate applicable law or another person’s rights.
• Interfere with the website’s operation, availability, security, or integrity.
• Attempt to gain unauthorized access to systems, accounts, or information.
• Upload or transmit malware, spam, automated requests, or harmful code.
• Impersonate another person or provide intentionally false or misleading information.
• Collect website information through scraping or automated means in a manner that burdens the site or violates applicable law.

We may restrict access or take reasonable protective action when we believe the website is being misused.

8. Intellectual Property

Unless otherwise stated, the website’s text, branding, illustrations, graphics, layout, and other original content are owned by or licensed to Acuity Counseling and are protected by applicable intellectual-property laws.

You may view, print, or share a reasonable portion of publicly available content for personal, noncommercial, informational use when you retain any attribution included with it. You may not reproduce, sell, modify, republish, or use our branding or substantial website content for commercial purposes without written permission.

9. Voluntary Website Feedback

If you voluntarily send suggestions specifically about the design, functionality, or improvement of the public website, you permit us to consider and use that feedback without compensation. This provision does not apply to general inquiries, employment applications, appointment requests, clinical communications, or information protected by privacy or confidentiality obligations.

10. Website Availability and Accuracy

We work to keep website information useful and current, but information may occasionally be incomplete, outdated, or unavailable. Services, clinician availability, insurance participation, fees, and website features may change. Please contact us or use the appropriate secure system to confirm information that is important to a care or financial decision.

The website is provided on an “as is” and “as available” basis to the extent permitted by law. We do not promise that every feature will always be available, uninterrupted, secure, or error-free.

11. Website Liability

To the extent permitted by law, Acuity Counseling is not responsible for indirect, incidental, special, or consequential losses caused solely by use of, inability to use, or reliance on the public website or an external website linked from it.

This section does not apply to clinical services, obligations established by a clinical agreement, or any responsibility that cannot lawfully be excluded or limited. Nothing in these Terms limits rights or remedies available under applicable law.

12. Privacy and Analytics Choices

Our Privacy Policy explains how we handle information collected through the public website. Optional analytics are not loaded unless you allow them. You may review or change that choice through Privacy choices in the website footer.

Clinical information is governed by our Notice of Privacy Practices and the agreements that apply to your care.

13. Changes to the Website or These Terms

We may update the website or these Terms to reflect changes in our operations, services, technology, or legal obligations. The effective date above identifies the current version. Material changes will be communicated when required by law.

14. Governing Law and Severability

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles, to the extent those laws apply. If any provision is found unenforceable, the remaining provisions will continue to apply. Failure to enforce a provision does not waive the right to enforce it later.
